LaMonica McIver Loses Bid to Dismiss Federal Assault Charges Following Oversight Visit to ICE Facility

A federal appeals court has upheld criminal charges against Representative LaMonica McIver after she attempted to have them dismissed on the grounds of legislative immunity. The 2-1 decision by the U.S. Court of Appeals for the Third Circuit ruled that McIver's actions during a 2025 oversight visit to the Delaney Hall detention center were non-legislative, meaning they were not protected by the Constitution's speech and debate clause. During the visit, McIver and other officials were involved in a physical standoff with ICE agents as they attempted to prevent the arrest of Newark Mayor Ras Baraka. McIver allegedly slammed her forearm into a federal officer and was charged with three counts of assaulting and impeding federal officers. While McIver argued that the charges were vindictive and a result of political retaliation by the Trump administration, the court majority determined that her actions were not integral to the legislative process. McIver stated that the decision emboldens the administration to persecute those who hold the president accountable.
