Ervin Joaquin Gutierrez Charged with Murder After Fatal Shooting During Argument Over Enchilada Spice Levels

Ervin Joaquin Gutierrez was charged with an open count of murder following a fatal shooting in Albuquerque that began as a minor disagreement over food. The 22-year-old man is accused of fatally shooting his cousin, Nathaniel Cavazos, after an evening of drinking and cooking green chile enchiladas. According to the arrest warrant, the tension escalated when Gutierrez claimed the chile on his plate was hotter than the chile on Cavazos' plate. The argument led to a physical fight in which Cavazos punched Gutierrez, leaving him bleeding. As Cavazos attempted to walk away, Gutierrez allegedly pulled out a handgun and fired three or four times, striking Cavazos in the back. Gutierrez turned himself in to police on Saturday and is currently being held at the Metropolitan Detention Center. A detention hearing is scheduled for next week in the Second District Court.
