Kings County Superior Court Judge Jennifer Giuliani ruled that four recalled Avenal City Councilmembers unlawfully held their seats after the recall results were certified on May 28. The dispute began after city leaders moved to create a volunteer fire department, a decision residents felt lacked sufficient community input. While the city council members initially refused to accept the results and continued to hold meetings, the court's decision solidifies the voters' mandate. Recall leaders, including Dalila Barajas, celebrated the victory as a confirmation of the constitutional right to recall. Attorney Oshea Orchid noted that the recalled councilmembers could potentially face charges for city funds spent during the period they were no longer legally entitled to hold office. City Manager Antony Lopez stated that the council will pause meetings until new members are seated following the November elections. The ruling clarifies that Alvaro Preciado is eligible to run again in November, where voters will decide who will fill the four affected seats.
