The Justice Department has requested that a federal appeals court reinstate criminal charges against Kilmar Abrego Garcia, a Salvadoran national who was mistakenly deported to El Salvador. The request follows a May ruling by U.S. District Judge Waverly Crenshaw, who dismissed the charges of human smuggling because the government acted with "presumptive vindictiveness." Judge Crenshaw noted that the administration only brought the man back to face trial after he successfully sued the government over his wrongful deportation. Federal prosecutors argue that the decision to indict Kilmar Abrego Garcia was based on legitimate evidence and the law, rather than retaliation. They contend that the judge's ruling represents an unwarranted intrusion into the executive branch's power. Conversely, defense attorneys for Kilmar Abrego Garcia argue that the prosecution was a political vendetta initiated by the administration to punish him for exposing their unlawful actions. The man, who lived in Maryland with his family, was deported to El Salvador's CECOT mega-prison despite a 2019 court order prohibiting his deportation to that country. The administration continues to seek a new deportation destination for him.
