While the transition of ownership is underway, the resort will remain fully operational. A key point of negotiation involves the Greenbrier's casino, which faced a potential temporary closure while awaiting approval from the West Virginia Lottery Commission. However, acting Lottery Director David Bradley suggested that the casino can remain open during the transition if the new board members are insulated from operational authority until the final vote. The deal settles a federal court battle over the resort's control and ends a lawsuit by White Sulphur Springs Holdings. The Justice family has owned the property since 2009, and the new partnership aims to restore the resort to its former glory while maintaining its status as a premier destination.
