Defense attorney Kevin Reddington files motion for not guilty finding in Lindsay Clancy murder trial

Defense attorney Kevin Reddington filed a motion requesting that Judge William Sullivan enter a required finding of not guilty in the case of Lindsay Clancy. The motion follows a mistrial declared on September 4 after a jury of 12 could not reach a unanimous verdict. Reddington argues that the prosecution failed to provide sufficient evidence to prove Clancy was mentally capable of conforming to the law during the 2023 murders of her three children. He contends that the evidence established she suffered from a serious mental illness, specifically postpartum psychosis, and that the prosecutors did not prove she understood the wrongfulness of her acts. The motion asserts that while the eleven jurors who applied the reasonable doubt standard reached a conclusion of not guilty by lack of criminal responsibility, the one holdout juror refused to apply that standard. Reddington argues that the evidence was sufficient to prove she had a mental disease or defect, but the prosecution failed to prove guilt beyond a reasonable doubt. If the court finds Clancy not guilty by lack of lack of criminal responsibility, the case will not be retried.
