New Jersey officials petition the Supreme Court to resolve conflicting rulings on prediction market regulation
New Jersey officials have petitioned the Supreme Court to weigh in on a nationwide legal battle regarding the regulation of prediction markets. The request follows conflicting rulings from lower courts. In April, the 3rd U.S. Circuit Court of Appeals sided with the prediction market platform Kalshi, ruling that federal oversight by the Commodity Futures Trading Commission (CFTC) preempts state gambling laws. However, in August, the 9th U.S. Circuit Court of Appeals ruled against Kalshi in a case involving Nevada, finding that federal regulation does not necessarily supersede state-level oversight of sports-related contracts. New Jersey Attorney General Jennifer Davenport stated that the divide between the two courts holds tremendous importance for the multi-billion-dollar gaming industry. While Kalshi argues that its sports-related contracts are financial swaps rather than bets, several states, including Connecticut and New York, have filed lawsuits to enforce sports gambling laws on the platform. President Trump has stated that it is critically important that the CFTC's exclusive authority over prediction markets is maintained.
