The Federal Trade Commission sued Hims & Hers on Wednesday, alleging the telehealth platform shared customer health information with third-party platforms like Meta and Snap without user consent. The complaint, filed in the Northern District of California, claims the company flouted its promises to keep medical conditions private while using tracking technologies to create specific audiences. In response, Hims & Hers dismissed the allegations as baseless and stated that their privacy policy clearly allows customers to make informed decisions about how their data is used. The company also noted that information shared with healthcare providers is used specifically for providing care. The FTC further accused the company of failing to clearly disclose prescription charges and making it difficult for users to cancel subscriptions. Following the lawsuit, shares of the publicly listed company fell nearly 15% on Wednesday.
