Beshear noted that McConnell has cast zero votes and engaged in no official activities during this period, arguing that the attending physician's statements have not sufficiently clarified if the senator can speak, reason, or perform his duties. If McConnell fails to provide a direct address to the people of Kentucky, Beshear plans to ask Senate Majority Leader John Thune to investigate the senator's condition. While McConnell's office has released two photos and written statements, it has declined to comment on Beshear's letter. McConnell is scheduled to retire at the end of his current term in 2026, and a vacancy would require a special election under Kentucky state law.
