The Pentagon is requesting broad new authority from Congress to withhold "controlled unclassified information" (CUI) from the public under the Freedom of Information Act. The legislative proposal would allow the defense secretary to exempt records from disclosure if the military determines that the harm of releasing the information outweighs the public interest. While the CUI system was originally designed to standardize how agencies safeguard sensitive data, it does not currently grant the authority to withhold records from the public. The new proposal would fundamentally change this relationship, allowing the Defense Department to use CUI as a primary reason to keep documents private. The administration announced that the proposal aims to provide more uniform protection for sensitive military information against foreign adversaries. However, transparency advocates and watchdog groups have expressed concern that the move could make it more difficult for the public to scrutinize how taxpayer dollars are spent. Critics note that much of the information the Pentagon seeks to protect is already shielded under existing laws.
