The referral stems from a deposition last year in which Jordan alleges Smith made "willfully and intentionally false statements" regarding the phone records of members of Congress. While Smith testified that his team only secured toll records—which include call details but not content—newly obtained documents reveal that his team also reviewed text messages between White House officials and 44 lawmakers. Jordan argues that Smith failed to proactively disclose these messages, which were obtained from the National Archives. The administration announced that the Justice Department will investigate all evidence of criminal conduct following the referral. Smith’s attorneys defended his testimony as "unimpeachably truthful," arguing that the committee failed to ask the specific question regarding the text messages. Meanwhile, Rep. Jamie Raskin, D-Md., dismissed the referral as "baseless and vindictive," claiming the Republicans are attempting to weaponize the justice system against a nonpartisan public servant.
