xAI Sues Terry Wayne Harwood for Using Grok Chatbot to Generate Non-Consensual Child Sexual Abuse Material

xAI filed a lawsuit in a Texas federal court on Tuesday against Terry Wayne Harwood, a South Carolina man arrested earlier this year for sexually exploiting minors. The lawsuit marks one of the first instances of an artificial intelligence company suing a user for generating child sexual abuse material. The complaint alleges that Terry Wayne Harwood violated the company’s terms of service by using "misleading prompts" to circumvent Grok’s built-in safeguards. While the chatbot often rejected explicit requests, Harwood reportedly used multiple accounts to "nudify" non-sexual photographs of both adults and children without their consent. xAI argues that the user is responsible for the outputs, characterizing Grok as a neutral tool subject to user control. The company is seeking unspecified monetary damages and a permanent ban on Harwood’s use of the platform. By pursuing this case, xAI aims to establish that users, rather than the developers, bear the primary liability for AI-generated content. The firm has already suspended over 52,000 accounts and made more than 73,000 reports to the National Center for Missing & Exploited Children.
