Elon Musk’s xAI Sues Terry Wayne Harwood Over Alleged Generation of Child Sexual Abuse Material Using Grok
Elon Musk’s xAI filed a lawsuit against Terry Wayne Harwood, a South Carolina man, alleging he intentionally violated the company's terms of service. The lawsuit claims Harwood used the Grok chatbot to create child sexual abuse material (CSAM) by circumventing built-in safeguards. According to the filing, Harwood allegedly misused the tool to convert non-sexual photographs into explicit images without the subjects' consent. The legal complaint details that Harwood opened multiple accounts and used "misleading prompts" to bypass moderation guardrails. The action represents one of the first lawsuits brought by a tech company against a user over the creation of explicit AI content. xAI is seeking monetary damages and a permanent court order barring Harwood from using the platform. The company noted that Harwood’s alleged misuse exposed xAI to significant legal risk. The legal dispute continues amid increased scrutiny of generative AI tools regarding the safety protocols protecting minors.
